The City of Sault Ste. Marie wants a hearing over a judge’s decision regarding Essar Steel Algoma’s unpaid municipal tax bill.

In a media release issued on Wednesday, the city said its legal team has issued a motion for leave to appeal the decision made by Justice Newbould, regarding a dismissed motion for payment of post-filing property taxes.

The city said its seeking to establish the grounds necessary to have an appeal hearing.

Back in May, the city’s original motion was dismissed by Newbould, on the understanding Essar would begin paying $350,000 per month to the city.

No payment was ordered for the $11 million owed by the steelmaker in post-filing taxes.

The company has also racked up about $14 million in pre-filing taxes.

The city said the leave to appeal identifies 'a number of errors in law and fact that serve as grounds for the appeal to be heard'.

Essar was granted protection back in November 2015 under Companies’ Creditors Arrangement Act proceedings.

The company has since changed its name to ‘Algoma’. The steelmaker announced that decision in May.
