The driver of an ATV was pulled over by police July 6 on Highway 11 in northern Ontario for not wearing a helmet.

After an investigation, however, they were arrested for impaired driving.

James Bay Ontario Provincial Police stopped the ATV around 9 p.m. in Opasatika, just west of Kapuskasing.

“Upon speaking with the driver, police determined that they had been consuming an alcoholic beverage,” the OPP said in a news release Wednesday.

“The driver was arrested and transported to the Kapuskasing detachment for further testing.”

The 49-year-old driver from the southern Ontario community of Leamington was charged with impaired driving and driving an off-road vehicle without a helmet.

The accused was released from custody and is scheduled to appear before the Ontario Court of Justice on Aug. 12 in Kapuskasing.

The accused was also issued a 90-day driver’s licence suspension and the vehicle was impounded for seven days.
