A judge's decision on a charter application put forward by the lawyer representing the lone person facing criminal charges in relation to the Algo Centre Mall collapse has been re-scheduled.

Former engineer Robert Wood has been charged with two counts of criminal negligence causing death and one count of criminal negligence causing bodily harm, in connection to the fatal 2012 mall collapse in Elliot Lake.

Doloris Perrizzolo and Lucie Aylwin were killed in the collapse.

Defence lawyer Robert MacRae has entered a delay application arguing it took too long after Wood was charged for a trial to begin.

Wood was charged in January 2014 and his trial started in September 2016.

On Friday, the Ministry of the Attorney General said Justice Edward Gareau has informed the ministry he will be rendering his judgement on the delay application on July 25.

That’s also the date set for Gareau to announce his verdict in the trial; which wrapped up back in February.

Previously, Gareau had set aside June 1 to announce his judgement on the application.

If the judge agrees with the application, the case could be thrown out.
